These Terms of Service ("Terms") govern your use of the lusatiqbkp website and fleet leasing services provided by lusatiqbkp B.V., a company registered in the Netherlands.
By accessing our website at lusatiqbkp.life or using our fleet leasing services, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing our services. lusatiqbkp reserves the right to modify these terms at any time, and such modifications will be effective immediately upon posting on our website.

We specialise in providing fleet leasing and vehicle management services to businesses across the Netherlands.
lusatiqbkp provides fleet leasing services including but not limited to corporate vehicle leasing, fleet management, commercial vehicle solutions, maintenance services, insurance coordination, and related automotive services. All services are subject to separate lease agreements and contracts that will contain specific terms and conditions applicable to each leasing arrangement.
Users of our website and services agree to provide accurate and complete information when submitting enquiries or applications. You are responsible for maintaining the confidentiality of any account information and for all activities that occur under your account. You agree not to use our services for any unlawful purpose or in any way that could damage, disable, overburden, or impair our website or services. Users must comply with all applicable laws and regulations when using our services.
The content, organisation, graphics, design, compilation, magnetic translation, digital conversion, and other matters related to the lusatiqbkp website are protected under applicable copyrights, trademarks, and other proprietary rights. Fleet leasing services are provided under separate lease agreements that contain specific terms regarding vehicle use, maintenance responsibilities, insurance requirements, mileage limitations, and return conditions. These lease agreements will govern the relationship between lusatiqbkp and the lessee for the duration of the lease term. In case of conflict between these general Terms of Service and a specific lease agreement, the lease agreement shall prevail.
Payment terms for fleet leasing services will be specified in individual lease agreements. Generally, payments are due monthly in advance and must be made in Euros. Late payments may incur additional charges as specified in the lease agreement. lusatiqbkp reserves the right to suspend services for non-payment and to pursue all available legal remedies for collection of outstanding amounts.
Leased vehicles must be used in accordance with the terms of the lease agreement and applicable laws. Vehicles may not be used for racing, commercial purposes beyond those specified in the agreement, or any illegal activities. Lessees are responsible for maintaining vehicles in good condition and for reporting any accidents or damage immediately. Modifications to leased vehicles are prohibited without prior written consent from lusatiqbkp.
lusatiqbkp will maintain appropriate insurance coverage for leased vehicles as specified in lease agreements. However, lessees may be responsible for deductibles and damages not covered by insurance. Lessees agree to cooperate fully in any insurance claims and to provide all necessary documentation. Additional insurance requirements may be specified in individual lease agreements based on vehicle type and intended use.
To the maximum extent permitted by law, lusatiqbkp shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses resulting from your use of our services. Our total liability for any claims arising from our services shall not exceed the amount paid by you to lusatiqbkp in the twelve months preceding the claim. This limitation applies regardless of the legal theory upon which the claim is based.
lusatiqbkp shall not be liable for any failure or delay in performance under these Terms or any lease agreement that is due to fire, flood, earthquake, elements of nature or acts of God, acts of war, terrorism, riots, civil disorders, rebellions or revolutions, or any other cause beyond our reasonable control. In such events, we will use reasonable efforts to mitigate the impact and resume normal operations as soon as practicable.
We may terminate or suspend your access to our services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, your right to use our services will cease immediately. Specific termination provisions for lease agreements will be detailed in individual contracts. All provisions of these Terms which by their nature should survive termination shall survive termination, including ownership provisions, warranty disclaimers, and limitations of liability.
These Terms shall be governed by and construed in accordance with the laws of the Netherlands, without regard to its conflict of law provisions. Any disputes arising from these Terms or our services shall be subject to the exclusive jurisdiction of the competent courts in the Netherlands. If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
We encourage resolution of disputes through direct communication. If a dispute cannot be resolved through negotiation, it may be submitted to mediation before pursuing litigation. Any legal proceedings must be commenced within one year after the cause of action arose. For consumer transactions, statutory rights under Dutch and EU consumer protection laws remain unaffected by these Terms.
lusatiqbkp reserves the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on our website and updating the "last updated" date. Your continued use of our services after any modifications constitutes acceptance of the updated Terms. It is your responsibility to review these Terms periodically for changes.
If any provision of these Terms is found to be unenforceable or invalid under any applicable law, such unenforceability or invalidity shall not render these Terms unenforceable or invalid as a whole. Such provisions shall be deleted without affecting the remaining provisions herein. The remaining provisions shall remain in full force and effect.
